RecoveryPlus.health, doing business as R Plus nutrition (“R Plus nutrition”, “we”, “our” or “us”) and governs your use of R Plus nutrition services (“Service”), including all services offered via websites and applications (together, “Website”). This privacy policy (“Privacy Policy”) applies to any information about you that we and the Services and/or the Websites collect. This Privacy Policy, collectively with the Terms of Service constitute the “Agreement” (the “Agreement”) between you and us for your access to and use of the Websites and the Services. All capitalized terms used in this Privacy Policy that are not defined herein shall have the meaning given to them in the Terms of Service.

You should read the Agreement carefully as together, and the Agreement forms the basis of our legal relationship with you and they affect your rights and liabilities under the law. By accessing and using the Websites, you confirm that you have read, understand and accept the Agreement and that you agree to abide by its terms and conditions each time you access and use the Websites and Services including any amendments that we may make to them from time to time. IF YOU DO NOT AGREE TO BE BOUND BY ALL OF THE AGREEMENT, YOU MUST NOT USE THE SERVICES.
We are committed to safeguarding the privacy of our Website visitors and Service users. We respect your right to privacy and aim to comply with our obligations under the applicable data protection legislation currently in force. The purpose of this Privacy Policy is to outline how we deal with any personal data that we collect from you or that you provide to us while visiting the Websites and using the Services. All uses of our Websites and Services are subject to this Privacy Policy. We use your information only as set out in the Privacy Policy and the Agreement. 1. INFORMATION WE COLLECT FROM YOU

When registering as a user of the Websites or during your time as a user of the Websites and the Services, you will be asked to provide information to us in order for us to provide the Services to you. By submitting the information, you are expressly agreeing to us processing that information in accordance with this Privacy Policy. We may access your user account for technical processing and to address technical problems or service complaints.
We collect information in three primary ways:

(b) We collect it automatically when you visit the Websites and use the Services;
(c) We obtain it from other sources, such as your health care provider.
Such information is only kept for as long as it is required for us to provide you with the Services, to comply with the law or our contractual obligations to you.
We do not knowingly collect personally identifying information from children unless we first obtain permission from that child’s parent or legal guardian.
When registering as a user of the Websites and the Services, you will be prompted to input information in order to fully avail of the Services selected by you. You can amend and update your user profile at any stage by accessing your user profile. We may collect different types of personal and other information based on your use of our Websites and the Services, including:
(a) Contact Information that allows us to communicate with you, including your name, address, telephone number and email address;
(b) Your username and password;
(c) Equipment information (including, but not limited to, mobile device brand, model, uuid, screen resolution, Internet provider, OS version, and display resolution), Performance, Websites Usage, Viewing and other Technical Information about your use of our network, Services, products or Websites;
(d) Health Information;
(e) Please note that your health care provider/medical practitioner will be able to add additional notes, if you so consent to your health care provider/medical practitioner doing so; and
(f) Your acceptance of the Agreement (including this Privacy Policy).

2. PURPOSES FOR WHICH WE HOLD YOUR INFORMATION

Personal Data

The data that identifies you or can be used to identify or contact you, and may include but not be limited to your name, address and email address, in circumstances where they have not been deleted, clipped or anonymized, and telephone number.
We will process any personal data that you provide to us for the following purposes:
(a) To provide you with the Services you have ordered;
(b) To carry out our obligations arising from any agreement entered into between you and us;
(c) To deliver and maintain high quality services and to improve and develop the Services provided and the Websites generally;
(d) To allow you to access the Websites and Services and to participate in interactive features of our Services, when you choose to do so;
(e) To provide you with information, products or services that you request from us or that we feel may interest you;
(f) To contact you if required in connection with your order or to respond to any communications you might send to us;

(l) To compare information for accuracy, and verify it with third parties. Examples of these third parties include insurance companies, carriers, our payment processor, and our service provider for managing customer support tickets;
(m) For safety purposes, to provide you with customer support and to resolve technical or other problems;
(n) If you avail of any Services, we may use your email address to send you updates or news regarding those Services. If you do not wish to receive emails of this type, please contact us.

Other Data

Like most websites, we gather statistical and other analytical information collected on an aggregate basis of all visitors to the Websites (“Other Data”). This information can be collected through the use of cookies, web server logs and log tracking, for example. This information comprises that cannot be used to identify or contact you, such as demographic information regarding, for example, browser types, operating system, traffic data, location data, information regarding the volume and status of data transmission, click-through statistics, the name of the domain and host from which you access the Internet, error codes or success codes the date and time you access portions of the Website, and other anonymous statistical data involving the use of the Website. This is statistical data about our users’ browsing actions and patterns, and we do not use them to identify any individual, except if required by the law or for the purposes of fraud protection, IT security and credit risk reduction.
We ask that you do not enter personal information, sensitive personal data or financial information into your profile. For example, do not use your address as your user name, because if you do then it may be posted publicly on the Websites and the information will then be treated as “demographic information” that is public information.
We use the Other Data gathered from visitors to the Websites and Services in an aggregate form to get a better understanding of where our visitors come from and to help us better design and organize the Websites.

3. DISCLOSURE OF INFORMATION TO THIRD PARTIES AND ADVERTISING

We may provide Other Data to third parties, where such information is combined with similar information of other users of the Websites. For example, we might provide third parties with aggregate anonymized information regarding the number of unique users who visit the Websites, the demographic breakdown of our community users of the Websites, or the activities that visitors to the Websites engage in while on the Websites. Please note that if you post personal information on public sections of the Websites, then you are consenting to giving a third-party user of the Websites to use your data; we are not responsible for the manner in which those third parties may choose to allow them use your data.
If you provide personal data to us, you understand and agree that we may disclose your personal data to the following third parties:
(a) to our hosting providers;
(b) to our payment processing service providers;
(c) to any third-party service providers who provide any service on behalf of R Plus nutrition, which you have availed of as part of the Services in order for R Plus nutrition to perform its Agreement with you;
(d) if you have indicated at any time while using the Websites or the Services that you are happy to receive information or promotions from selected third parties about goods and services which may be of interest to you, you consent to us sending you such offers or information. If you wish to opt out of receiving such offers, please contact us;
(e) any member of our group of companies, which means our subsidiaries, our ultimate holding company and its subsidiaries and our affiliates;
(f) to a prospective seller, shareholder or buyer of some or all of the shares in RecoveryPlus.health, the Websites and/or any of our businesses or to a third party in the event of a sale, merger, liquidation, receivership, purchase or transfer of the business or assets related to the Websites or all or part of RecoveryPlus.health;
(g) to a third party if we are under a duty to disclose or share your personal data with that third party in order to comply with any legal obligation, or in order to enforce or apply our Agreement with you or any other relevant agreements, or to protect the rights, property or safety of RecoveryPlus.health, the Websites and/or our customers or others. This includes but not limited to exchanging information with third parties for the purposes of fraud protection, IT security and credit risk reduction.
We will notify you when your personal data may be provided to third parties in ways other than explained in this Privacy Policy and you will have the option to prevent such information sharing at the time that we notify you except where the sharing of such information is necessary for the performance of any agreement that you may have entered into with Services in respect of a service that you have ordered.
We reserve the right to transfer information (including your personal data), unless you have the other Website user’s express permission or our express written permission you may not disclose or contact another user for any purpose.
We use the information provided by you in order to offer you the Services for which you have subscribed. We use your email information and other personal information to operate the Websites efficiently and to contact you in relation to your transactions, to forward messages to/from you to/from other members, and to inform you of what is happening on the Websites. These communications to you may also contain commercial messages e.g. banner ads, promotional offers etc. These communications are an obligatory part of the functioning of Websites and receipt of these is a function of Websites membership. We may use a third-party advertising company to serve ads when you receive these communications. These companies may use information (not including your name, address, email address or telephone number) in order to provide advertisements about goods and services that may be of interest to you. Where third parties act as processors of information on our behalf, we require that they comply with our privacy statement.
You may opt-out from receiving communications from R Plus nutrition (other than those necessary for R Plus Health to provide the Services for which you have subscribed) at any time by emailing us at support@rplushealth.com This will mean your account is no longer active and you will need to set up a new account with us to avail of our service.

4. YOUR DATA RIGHTS AND DELETION REQUESTS

You have the right to access, rectify, or request the deletion of your personal data held by R Plus nutrition. To submit a data deletion request, please send a detailed request to our privacy team at support@rplushealth.com. In your request, please specify the data you wish to have deleted and provide sufficient information to allow us to verify your identity (e.g., your full name, registered email address, and any relevant user ID). We will process your request within a reasonable timeframe and in accordance with applicable data protection laws and regulations. Please note that certain data may be retained for legal or essential business purposes, as outlined in this Privacy Policy and our Terms of Service. Upon successful verification and as permitted by law, your personal data will be removed from our active systems.

5. COOKIES

About Cookies

(b) security – we use cookies as an element of the security measures used to protect user accounts, including preventing fraudulent use of login credentials, and to protect our website and services generally. The relevant cookie(s) are: user ID, username, access token, milestone.

When you avail of certain services provided by R Plus nutrition on the Websites as part of the Services, you may leave the Websites as certain of the Services are provided by third-party service providers. Please note that these providers have their own privacy policies and terms of use and that we do not accept any responsibility or liability for these policies, their terms or for the activities on those websites.
R Plus nutrition may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates as well as third-party websites to which we have no affiliation. Elements of the Services may be provided by third parties and when you avail of such services, you will leave the Websites and you acknowledge use of such services is subject to the privacy policy and terms and conditions of that service provider, with which you are obliged to familiarize yourself.
Users of the Website may post links to other websites also. If you follow a link to any of these websites, please note that these websites have their own privacy policies and terms of use and that we do not accept any responsibility or liability for these policies or for the activities on those websites.

8. SUBSCRIPTION AGREEMENT

We offer monthly and annual subscription plans (“Subscription Plans”) to meet the needs of different users. The terms and conditions of the Subscription Plans are as follows:

(a) Subscription Types:
We offer two types of subscription plans: monthly subscription and annual subscription. The content and privileges of each subscription plan will be detailed on the subscription page.
(b) Subscription Content:
The specific content and privileges of the subscription plans will be detailed on the subscription page.
(c) Subscription Fees:
The fees for the monthly subscription and annual subscription will be detailed on the subscription page. We reserve the right to adjust subscription fees at any time and will notify users in advance.
(d) Payment Method:
Subscription fees will be processed through Apple Pay and Google Play.
(e) Subscription Term:
Subscription plans are available in monthly and annual terms. The specific subscription term will be detailed on the subscription page.
(f) Automatic Renewal:
Unless you cancel your subscription before the end of the subscription term, your subscription will automatically renew and you will be charged according to your initially selected payment method. You can cancel automatic renewal at any time through your account settings.

Cancellation and Refunds

(a) Cancel Subscription:
You can cancel your subscription at any time through your account settings. After canceling, you can continue to use the subscription services until the end of the current subscription period.
(b) Refund Policy:
Subscription fees that have already been paid will not be refunded upon cancellation. We do not offer partial refunds for subscription periods.
